(1) A police officer who is not satisfied with the promotion recommendation made by the promotion committee may file a complaint with the following committee within fifteen days from the date of promotion recommendation:-
(a) Chief Secretary to the Government of Nepal – Chairman
(b) Office of the Secretary (Law), Prime Minister and Council of Ministers – Member
(c) Representative, Gazetted First Class, Public Service Commission – Member
(2) After receiving the complaint, the committee under sub-rule (1) shall send the feedback of the promotion committee and the documents related to the complaint in writing to the secretariat of the promotion committee within seven days of the expiry of the deadline for making the complaint. If written in such a manner, the secretariat of the promotion committee shall send the documents related to the complaint to the complaint hearing committee within three days.
(3) In the evaluation of the basis of the promotion taken on the recommendation made by the promotion committee, if any reason or basis is required to be disclosed, if the same is not disclosed, or if a candidate has not received the rank that should be received according to this regulation, the recommendation of the promotion committee on the basis of receiving the rank If it seems necessary to amend, it should also be sent in writing to the promotion committee.
(4) According to sub-rule (3), if there is an amendment to the recommendation made by the promotion committee by the promotion complaint hearing committee, the promotion committee shall publish the list of promotions according to the order of merit after the amendment.
(5) If a complaint is made according to sub-rule (1), it should be filed within twenty one days from the date of expiry of the complaint deadline.
(6) The recommendation of the promotion committee will be implemented only after the complaints filed in accordance with this rule are resolved.
(7) If the complaint made as per sub-rule (1) is found to be false, the promotion after the complaint will be deducted by two points in case of first complaint and three points in case of second complaint.
(8) The office of the Prime Minister and the Council of Ministers shall act as the secretariat of the grievance hearing committee as per sub-rule (1).
